Terms and Conditions
(ConSec)
This agreement is a legal agreement between you and ConSec. By accepting it electronically (by installing the application with all its services, or by accessing or using them), you agree to these terms. If you do not agree to this agreement, it is preferred that you do not use these services.
Important and Frequently Used Terms:

ConSec: Refers to the electronic application available on smart devices, hereafter referred to as the ConSec App.

User: The client requesting a service, registered as a user and benefiting from the services provided by the application.

Service Providers: All business owners offering services in the app, such as engineers, designers, consulting offices, construction companies, subcontractors, suppliers of building materials, elevators, water heaters, HVAC systems, and all devices and materials related to construction, as well as technicians and others.
Introduction
Your use of the ConSec App implies your commitment to the terms and conditions stated on this page, which represents a formal contract between ConSec and its users, both clients and service providers.
ConSec is a platform that connects users with service providers.
By using the app, you implicitly agree to all of its terms and conditions. If you do not agree to any of them, you must not use the application.
ConSec reserves the right to update or change the terms and conditions without prior notice. Users are expected to review them regularly to be aware of any changes. The ConSec team is not required to notify users of any updates. Users are also encouraged to review the privacy policy to understand how the app uses collected data. Any changes to these terms aim to protect the rights of both users and service providers.
1. Agreement to Terms of Use
1.1 This agreement sets out the terms governing your use of the ConSec App’s services online, including content, updates, and new versions ("services"). It includes:
1.2 The app's privacy policy provided with the services or available on the website.
1.3 Your use of the service is conditional upon your agreement to these terms and conditions. By using the service, you indicate your unconditional legal acceptance of these terms. No other terms from any document or communication between you and the app (or its staff/agents) apply.
1.4 Service providers acknowledge that ConSec charges an annual subscription fee as agreed upon with ConSec’s management for registration and offering services on the platform, which protects their rights.
2. Changes to the Agreement
2.1 ConSec reserves the right to change these terms at any time without notice. New or different conditions may be imposed and will be published in the app or on the website. These will become legally binding once posted.
2.2 You must regularly review these terms. Your continued use of the app indicates acceptance of any new terms.
2.3 ConSec has the right to modify, suspend, or discontinue any part of the app or its services at any time at its sole discretion.
2.4 ConSec can impose certain restrictions on users or service providers without requiring their approval.
3. Rights to Use ConSec Services
3.1 The services are protected under copyright and intellectual property laws. You are only granted the right to use the services for the purposes specified by ConSec.
3.2 ConSec retains all other rights and grants you a limited, personal, non-exclusive, non-transferable license to use its services as long as payment obligations are met and until this agreement is terminated. This use is subject to:

3.2.1 Complying with any policies or guidelines issued by ConSec, including technical specs, privacy, acceptable content, etc., which may be amended at any time.

3.2.2 ConSec has the right, at its discretion and without prior notice, to suspend or terminate your account if it deems your use inappropriate, illegal, or harmful. In such cases, ConSec is not liable to refund any prepaid subscription and may deduct costs from it or seek compensation by other means.

3.2.3 ConSec may modify or suspend services or the website at any time without notice.
3.3 You agree that:

3.3.1 ConSec may use your name as a service user for marketing or publicity globally.

3.3.2 Service providers must display ConSec’s name and logo on any work done via the platform.

3.3.3 ConSec owns any feedback provided and can use it to improve or create products/services.
4. Term and Termination
4.1 The agreement is ongoing as long as the app is installed and used.
4.2 The user may terminate the agreement by uninstalling the app.
4.3 ConSec may terminate your subscription without notice if you violate any terms. No subscription refund will be granted.
4.4 The agreement and your right to use the service end immediately upon subscription termination.
4.5 ConSec may retain your uploaded data after termination, though it is not obliged to maintain or restore it unless expressly stated.
4.6 ConSec is not liable for any claims, damages, or costs you may incur post-termination.
5. Privacy and Data Use
5.1 By registering for ConSec, you agree to:

5.2 Provide valid ID (for citizens) or valid residence (for expats in Kuwait).

5.3 Comply with all applicable Kuwaiti laws.

5.4 Submit accurate and complete information and keep it updated.

5.5 Update your registration data regularly.

5.6 Notify ConSec of any unauthorized access to your account. You are fully responsible for your account activity.

5.7 Use the app only for the available services/products.

5.8 Consent to your personal data being stored, accessed, and transferred globally via the internet.

5.9 ConSec may amend its privacy policy, which is part of these terms.
5.10 You agree:

Not to undermine the security or integrity of ConSec’s systems.

Not to misuse the services in a way that harms functionality or other users.

Not to access unauthorized materials.

Not to upload harmful, offensive, or illegal content.

Not to misuse the app for theft, harm, or stealing personal information.

Not to compete with ConSec or use its information to start a competing business.

Not to copy or distribute app content without written consent.

Not to reverse-engineer or try to access the app's source code or internal design.
6. Account Security
6.1 You are responsible for maintaining the confidentiality of your username and password.
6.2 If you suspect unauthorized access, you must act to disable your account or reset your password promptly.
6.3 You are responsible for actions by anyone using your account, especially if abusive or illegal.
6.4 ConSec is not responsible for stolen personal data if using an insecure public network.
7. Indemnity
7.1 You agree to indemnify and hold ConSec and its staff harmless from all claims, losses, or expenses arising from your content or breach of these terms or any third-party rights, including intellectual property rights.
8. Limitation of Liability
8.1 ConSec is not liable for any indirect, incidental, or consequential damages, especially involving disputes between users and third parties.
9. Warranties
9.1 Unless explicitly stated, ConSec provides services "as is" with no guarantees regarding content accuracy or completeness.
9.2 ConSec disclaims all warranties, including third-party advertising claims or marketing.
9.3 ConSec does not guarantee the app or its emails are free of viruses or harmful components.
9.4 ConSec is not responsible for data loss, errors, or security over the internet.
9.5 ConSec reserves the right to make changes or updates without notice.
10. Force Majeure
10.1 ConSec is not liable for breach of contract due to events beyond its control.
10.2 "Force majeure" includes natural disasters, fire, national emergencies, strikes, pandemics, or internet outages beyond ConSec’s control.
11. Intellectual Property
11.1 All content within ConSec belongs solely to ConSec and cannot be reused without permission.
11.2 All rights to services, media, and content on the app or website or social platforms belong to ConSec. No one may reuse or republish without written approval.
